FishCastPro - AI-Powered Fishing Forecasts

Welcome to Fishcast. These Terms and Conditions ("Terms") govern your access to and use of our mobile application, website, and related services (collectively, the "Service"). By using Fishcast, you agree to these Terms.

Eligibility

You must be at least 18 years old (or the age of majority in your country) to use Fishcast.

If you are under 18, you may only use the Service with the consent and supervision of a parent or legal guardian.

Free Trial (Reduced Access)

New users are provided a 14-day reduced-access trial.
During the trial you may:

Create and store up to 10 waypoints.
View maps, weather data, forecasts, notifications, and account settings.
Log up to 10 catches.
View your fishing locations, but not access extended information or editing tools.

Trial users cannot:

Join or form a School (group plan).
Unlock extended historical data, editing features, or premium analytics.

Trial users may be invited to a School, but will be directed to the subscription section to upgrade.

Subscriptions and Renewals

FishCastPro offers monthly and annual subscription plans. Prices may vary by region.
Subscriptions automatically renew unless canceled before the renewal date.

Refund Policy: Subscriptions are generally non-refundable, except as required by law. However, refund requests made within 7 days of purchase may be considered on a goodwill, case-by-case basis.

If your subscription lapses:

Your account will revert to trial status with the above limitations.
Only your 10 most recent inputs (catches/waypoints) will remain accessible.
You may renew within 30 days to restore full access to your data.
After 30 days without renewal, your account and all associated data will be permanently deleted.

Group Plans ("Schools")

A School is formed when four (4) or more active subscribers join together.
The School discount applies starting from the following billing cycle.
If the School falls below four active subscribers, the discount is removed in the next cycle and all members revert to the regular subscription rate.

If a member leaves a School:

That member forfeits ownership of any shared School data.
Their personal data remains private and accessible only to them, subject to Section 3 (renewals and data deletion).

If a School dissolves completely, shared School data is permanently deleted (except anonymised data retained for service improvement).

User Content and Data

You retain ownership of your uploaded waypoints, catches, notes, and content ("User Content").
By using Fishcast, you grant us a limited license to store and process your data solely for operating and improving the Service.
If you choose to mark data as shared, it may be visible to other users.

Safety and Compliance

FishCastPro provides forecasts, mapping, and data insights for informational purposes only.
We do not guarantee accuracy of weather, tides, or catch forecasts.
Always follow maritime safety laws and regulations in your jurisdiction.
FishCastPro forecasts must not replace official charts, government forecasts, or emergency guidance.

You are solely responsible for:

Checking official local weather forecasts and marine safety warnings.
Complying with local fishing regulations and quotas.
Ensuring personal and crew safety.

FishCastPro is not liable for accidents, injuries, or equipment losses.

Acceptable Use

You agree not to:

Use FishCastPro for unlawful or fraudulent purposes.
Interfere with the security or integrity of the Service.
Misuse or resell shared data.
Copy, modify, distribute, reverse engineer, or create derivative works of Fishcast, its software, or concepts.

Limitation of Liability

Fishcast, its owners, and affiliates shall not be liable for:

Any damages from reliance on forecasts, predictions, or shared content.
Any loss of data after account lapse or deletion.
Any accidents, injuries, or losses from fishing, boating, or outdoor activities.
Any damage, malfunction, or loss of fishing equipment, vessels, or accessories caused by reliance on forecasts or suggestions.

Termination

We may suspend or terminate accounts that violate these Terms or misuse the Service.

Changes to Terms

We may update these Terms from time to time. Continued use of FishCastPro after updates constitutes acceptance.

Governing Law

These Terms are governed by the laws of New Zealand and Australia, and may also be subject to consumer protection laws in your country of residence.
Any disputes will be handled in the courts of New Zealand, unless otherwise required by local law.

FishCastPro – Intellectual Property Notice

Fishcast™ and all associated logos, trademarks, designs, and branding are the exclusive property of FishCastPro Ltd.
All software, algorithms, source code, features, and UI components are protected by copyright, trademark, and intellectual property laws.
Certain FishCastPro technologies may be protected by pending or registered patents.

Prohibited activities include:

Copying, distributing, or modifying Fishcast.
Reverse engineering or deriving source code.
Creating competing apps or services based on FishCastPro concepts.
Using the FishCastPro name or branding without permission.

FishCastPro grants users a personal, non-exclusive, non-transferable, revocable license for lawful use only.
Fishcast™ is a registered or pending trademark in New Zealand, Australia, and other jurisdictions.
